L'Islam, dont la société se caractérise par un attachement massif à la règle et au précepte, n'en a pas moins connu au long des siècles les effets de courants divers. Mais cette société intègre des interprétations intérioristes ou mystiques, parfois en conflit avec la loi, et elle fait une place aux héritages des sagesses étrangères, iranienne et hellénique notamment.

Filant la métaphore du « bestiaire », cet article retrace les différents gestes du processus créateur de l’historien. Bien sûr, il ne s’agit pas ici d’emprunter des concepts aux travaux sur le symbolisme animal dont j’avoue très volontiers que je ne les ai pas consultés . Les figures animales convoquées dans ce court article correspondent à l’image que j’en ai, de façon spontanée et non savante. Quatre animaux peuvent être cités : le lion, la fourmi, le renard et le castor. (...) Dans les textes de Machiavel, la question de la guerre est souvent l’horizon même de la question de la politique. La politique et la guerre y sont en permanence mêlées, souvent indissociables ; cela dans les relations que les États établissent entre eux, mais aussi à l’intérieur même des États, des provinces et des cités. Il ne s’agit pas ici de couvrir l’ensemble de ce champ des liens entre la politique et la guerre, tâche impossible à mener dans le cadre (...) d’un article, mais seulement de traiter un des aspects de cette question : il s’agira de voir comment la polémique de Machiavel contre les armes mercenaires et auxiliaires et en faveur des « armes propres » est un des axes structurants de l’ensemble de l’œuvre, un des éléments qui donnent sens aux textes. L’erreur consistant à ne pas avoir compris l’importance des « armes propres » et le rôle déterminant de l’infanterie est un des « péchés des princes » de l’époque des guerres d’Italie ; dans l’écriture des textes de Machiavel on ressent un effort constant pour faire comprendre comment on pourrait racheter, « rédimer » (redimere), ces péchés. Les guerres d'Italie - qui débutent en 1494 - et les bouleversements qui s'ensuivent à Florence (où se met en place, après la chute des Médicis, la république du Grand Conseil), amènent Francesco Guicciardini (1483-1540) à réfléchir sur l'évidence« naturelle» du concept de libertàftorentina. Sa méthode - «ne pas se laisser à ce point tromper par les mots qu'on ne considère plus les choses» - lui fait abandonner la question du bon gouvernement pour lui substituer celle des effets qu'il produit (...) et le pousse à mettre en lumière, «sous la douceur du nom de liberté», les enjeux politiques. Dès lors, il n'y a plus d'évidence naturelle de l'aspiration à la libertà, mais la nécessaire analyse de la conjoncture politico-historique, de la « condition des temps ». (shrink)

Résumé Comment une histoire matérielle de l’abstraction peut-elle servir l’histoire intellectuelle ou bien l’histoire des sciences, cela à l’encontre de l’histoire des idées et des généalogies rétrospectives? L’objet est ici l’œuvre de connaissance telle qu’elle est ancrée dans son cadre historique. Cette histoire intellectuelle déborde les coupes disciplinaires. L’article en offre plusieurs exemples qui partent de la recherche de différenciations explicables entre des pratiques intellectuelles d’abstraction. Une séquence s’ouvre alors avec l’émergence d’une conception, puis la formation de théories et finalement (...) la consolidation d’un corpus de choses tenues pour évidentes. At the end of the nineteenth century, approaches from experimental physiology made inroads into embryological research. A new generation of embryologists felt urged to study the mechanisms of organ formation. This new program, most prominently defended by Wilhelm Roux, was called Entwicklungsmechanik. Named variously as “causal embryology”, “physiological embryology” or “developmental mechanics”, it catalyzed the movement of embryology from a descriptive science to one exploring causal mechanisms. This article examines the specific scientific and epistemological meaning of the mechanistic approaches of (...) embryological development by focusing on Wilhelm His’ histogenetic work. Roux was neither the first, nor the only one to argue for an experimental exploration of causes in embryology. At the time of Roux, physiological explanations of the genesis of the anatomical forms were developing in parallel, not only in German-speaking countries, but in France, Switzerland and English-speaking countries as well. The experimental approach and the cellular descriptions of embryogenesis were already omni-present when Roux proposed his Entwicklungsmechanik. However, these approaches remained disjointed. It appears that it was Wilhelm His who first succeeded in combining the question of the causal factors determining epigenesis, which was closely connected with experimentation on, and cellular descriptions of, development, in a coherent and concrete synthesis, making him one of the true initiators of the developmental mechanics. Translated texts sometimes reflect the writing tradition of the targeted law, but the equivalence of the source legal message, however, must be delivered in the target text. Translating law into a different legal culture cannot be accomplished without comparing laws, whose knowledge is essential to achieving legal equivalence. The way the target text is written should match its culture. Translating law is the moment when languages, cultures and laws meet. To materialize, this encounter has to be based on an ad (...) hoc knowledge of the laws at stake. Then comparative law, translators’ “fellow traveler”, comes into play, preparing them for the exchange. To achieve this, “one only needs two receptions which intersect”. This move is successful when concepts and notions overlap and the letter of law and its wording merge, revealing “the spirit of the laws”. Comparative analysis is the way to achieve this result. It is conducted here under the light of jurilinguistics with an analysis of terms and concepts presenting various translation difficulties, demonstrating the necessity of comparative law. The lessons to be learned are aimed at all language professionals wishing to draw inspiration from the jurilinguists’comparative analysis approach to their work. (shrink)

Foucault a souligné l’importance, pour la philosophie française du xx e siècle, des Méditations cartésiennes de Husserl, prononcées à la Sorbonne en 1929. Contrairement à Husserl, Foucault n’a pas réactivé le geste cartésien de l’auto-méditation et de la refondation du savoir philosophique sur des bases sûres. Mais il n’a cessé de revenir sur les Méditations métaphysiques de Descartes comme moment décisif pour l’apparition du sujet moderne – d’abord dans la fameuse lecture du « Mais quoi! ce sont des fous » (...) dans l’ Histoire de la folie. Mais Foucault ne s’en est pas tenu à cette interprétation, discutée par Derrida, qui reliait la construction du sujet rationnel à l’exclusion des fous. On trouve dans L’Herméneutique du sujet une nouvelle approche des Méditations métaphysiques, cette fois démarquée de Heidegger, qui les restitue dans l’histoire des « techniques de soi » et situe la rupture décisive au plan même de la dissociation entre technique spirituelle, accès à la connaissance et transformation éthique de soi. Cet article suit ainsi « la méditation cartésienne de Foucault » en mettant en lumière le constant débat sous-jacent avec les lectures de Descartes produites par la phénoménologie et la déconstruction de la métaphysique. Are universities able to operate as strategic actors? An organisational sociology based approach supported by a comparative field research project identifies three types of social, cultural and cognitive processes that play a decisive role in building and implementing local capabilities required to mobilise a strategic capacity. The paper identifies how much these processes are present in the four ideal-types of universities defined by crossing their reputation and their metrics-based performance. Such a meso deterministic perspective suggests that universities may position themselves (...) as proactive actors or principals, and not just as agents of national reforms and political demands. Nevertheless, their ability to do it varies according to their type. The paper also explores the implications of such findings for institutional leadership and steering policymakers. (shrink)

It is a common experience that we talk to some animals, especially those with which we share our human lives, such as dogs or cats. From this communication, should one conclude that these animals participate in intersubjectivity? Though Husserl’s phenomenology has a “Cartesian” tendency, in his late reflections on the variations of “normal” consciousness and the “normal” body, he suggests that there are degrees of subjectivity, following a more “Leibnizian” path. Scheler, Merleau-Ponty, and Levinas have also developed this thesis of (...) a “sympathy” with animals beyond the limits of the human species. (shrink)

Jean-Claude Simard Les humanités numériques constituent un domaine en plein développement. On en donne ici un exemple en analysant le contenu d’une revue et l’évolution des idées qui s’y sont exprimées depuis son origine. Pour ce faire, on a retenu Philosophiques, l’organe de la Société de philosophie du Québec, une revue qui n’avait jamais encore fait l’objet d’une étude fouillée.L’examen détaillé de son contenu procède en trois étapes. Comme les études sur l’évolution récente des idées en philosophie québécoise (...) ne sont pas légion, on rappelle d’abord les résultats d’une recherche en ce domaine réalisée avec les moyens traditionnels de la philosophie (Simard 1998). Puis on soumet les articles de la revue à un double traitement computationnel, l’un de style plutôt déductif, l’autre plus inductif. Enfin, les résultats de cette double analyse sont comparés avec ceux de 1998, dont l’étude était menée sur un corpus composé d’ouvrages. Le constat est clair : l’analyse assistée par ordinateur complète et précise le résultat de recherches plus classiques. On conclut avec quelques perspectives sur les humanités numériques. (shrink)

Current axiomatizations for extensive measurement postulate the existence of infinitely small objects. This assumption is neither necessary nor reasonable. This paper develops this theme and presents a more acceptable axiom system. A representation theorem is stated and proved in detail. This work improves some previous results of the author.

The implementation of a diplomacy that could put more emphasis on democracy and human rights was not an easy process in Belgium. Treatment of these matters have taken a different perspective in Zaïre, Rwanda and Burundi, Belgium 's three most important African partners. Reasons for that are twofold. Fore one thing, the Belgian foreign affairs service has always been overloaded by mercantile preoccupations. Secondly, knowledge on Africa has been limited to short circle diplomatic contacts while no instruments were ever implemented (...) that could have ensured some following up of the African civil society at large.In the future, the continuation for a slow process of disengagement might be foreseable. New "partners" might come to the forefront such as South Africa while the U.S. and international financial organisations will definitely try to impose "good governance" together with a reasonable dose of human rights. In reviewing the Belgian policy towards Zaïre for the last two decades, one is struck by a certain politica! as well as economic withdrawal which has become more obvious since the end of the sixties. In the context of the «Mobutu Plan», the Marshall Plan for Zaïre, or in that of the two Shaba upheavals, Belgium, unlike France with respect to its former colonies, has choosen to align itself with big powers policies and international organizations, and to avoid taking too (...) strong stands in the rather confuse situation which prevails in Zaïre today. Although unanimity does no langer exist among the various Belgian pressures groups about what is tobe done in Zaïre, the official policy of the government is entrenched in a «wait and see» attitude which points to the deepening contradictions within Western states towards Africa in general and Zaïre in particular. The Tindemans report on the European union and the decision to organize direct elections for the European Parliament have been two important events in European afjairs in 1976. This article analyses the origins, developments and bearing of these two events.Although his mandate was initiated and encouraged at the highest level - that of the European heads of state -, Mr. Tindemans' attempt to propose concrete steps in order to achieve a real political union in Europe did not get through. It (...) received a rather cold reception from several states who opposed some of his proposals on different grounds.At the Conference of The Hague, Mr. Tindemans was able to get a formal support to his ideas, but no decision was taken to implement any of them.The decision to organize direct elections for the European Parliament, which can be seen as a concrete step toward the implementation of the long awaited European union, is facing the same kind of resistance at the national level. Although the Nine have all agreed to do everything possible to organize these elections in the spring of 1978, there are still unsolved problems which are both technical and political. Moreover, even if they are taking place, it is not at all sure that they will bring about substantive changes in the role and functions of the European Parliament. (shrink)
